Terms and Conditions

These terms govern your use of goeterna.com and the services we provide. Please read them before you use the site, request a quote, or contact one of our agents.

By using goeterna.com or working with an Eterna agent, you agree to these Terms and to our Privacy Policy. Section 21 requires most disputes to be resolved by individual arbitration and waives your right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days.

01Acceptance of these terms

These Terms and Conditions (the "Terms") are a binding agreement between you and Eterna Insurance Solutions ("Eterna," "we," "us," or "our"). They govern your access to and use of goeterna.com, including all pages, forms, quote tools, calculators, booking tools, and content on it (the "Site"), and your engagement with our services.

You accept these Terms when you browse the Site, submit a form, request a quote, book an appointment, apply to become an agent, or communicate with our team by phone, email, or text. If you do not agree to these Terms, please do not use the Site or our services.

These Terms apply to every visitor, prospective client, client, agent applicant, and agent who uses the Site in any capacity. If you use the Site on behalf of a business or another person, you represent that you have authority to bind that party to these Terms.

02Who we are

Eterna Insurance Solutions is an independent insurance agency and Insurance Marketing Organization (IMO) headquartered in Irvine, California. We help families and pre-retirees compare and place life insurance and annuity products from licensed carriers, and we recruit, train, and support licensed independent agents.

Important

Eterna is not an insurance carrier. We do not underwrite, issue, or administer insurance policies. Every policy is issued by a licensed insurance carrier and is subject to that carrier's application, underwriting, terms, and approval. Eterna is not a bank, a broker dealer, a registered investment adviser, a law firm, or a tax advisor.

03Our services

Depending on your state and your needs, our services may include:

  • Life insurance consultation and policy placement, including term life, whole life, indexed universal life, and final expense
  • Annuity consultation and placement
  • Policy reviews and coverage needs analysis
  • Agent recruitment, contracting support, onboarding, training, and mentorship
  • Educational content about life insurance, protection planning, and retirement income
  • Online quote requests, contact forms, and appointment booking

Not all products and services are available in every state. Product availability, features, riders, and pricing are set by the carrier and can change without notice. We may add, change, suspend, or discontinue any part of the Site or our services at any time.

04Not financial, tax, or legal advice

Content on this Site, including articles, guides, videos, calculators, and illustrations, is provided for general educational and informational purposes only. It is not financial, investment, tax, or legal advice, and it is not a recommendation to buy or replace any specific product.

Any coverage estimate, premium figure, or calculator result shown on this Site is an illustration based on the assumptions entered. It is not an offer of insurance, a binder of coverage, or a promise of price or availability. Actual rates and terms are determined only through a formal application and underwriting review with the issuing carrier.

Product features described on this Site are summaries. The policy contract and any riders control in all cases. Where a product includes a guaranteed feature, that guarantee is backed solely by the claims paying ability of the issuing carrier, not by Eterna. Past performance and hypothetical index results do not predict future results.

Please speak with a licensed insurance professional, and with your own tax advisor or attorney where appropriate, before making a decision about coverage or a financial product.

05Licensing and regulatory compliance

Eterna Insurance Solutions and the agents who represent us hold active state insurance licenses in the states where we do business, and are appointed with the carriers whose products they present. Licensing rules, product filings, and disclosure requirements vary by state.

We conduct insurance business in accordance with applicable federal and state law, including the rules of each state Department of Insurance and applicable anti money laundering and suitability requirements. You may verify our license status, or the license status of any Eterna agent, with your state Department of Insurance.

Nothing on this Site should be read as an offer to sell or a solicitation to buy any insurance product in a state where Eterna or the presenting agent is not licensed and appointed.

06Eligibility

The Site and our services are intended for individuals who are at least 18 years old and who live in the United States. By using the Site, you represent that you meet these requirements and that any information you give us is your own or that you are authorized to provide it.

Eligibility for a specific insurance product is set by the carrier and may depend on age, health, financial suitability, existing coverage, and state availability. Meeting the requirements on this page does not mean you qualify for coverage.

07Accuracy of information

We work to keep the Site accurate and current. Even so, we make no representation that the content is complete, current, or error free. Carrier offerings, rates, underwriting rules, and regulations change often, and the Site may not reflect the latest information. Always confirm details with a licensed Eterna agent before you act on them.

You are responsible for the accuracy of the information you give us on contact forms, quote requests, agent applications, and insurance applications. Providing false or incomplete information on an insurance application may be insurance fraud. It can result in a declined application, a rescinded policy, a denied claim, and civil or criminal penalties.

08Quotes, applications, and underwriting

A quote is an estimate, not an offer of insurance and not a contract. Submitting a quote request or an application does not create coverage.

  • Coverage begins only when the carrier approves the application, issues the policy, and every condition of issue has been met, including payment of the initial premium.
  • The carrier decides whether to approve, modify, rate, or decline an application. Eterna does not make that decision and cannot reverse it.
  • Final premium may differ from any quoted amount after underwriting, medical review, and prescription or motor vehicle checks.
  • Do not cancel existing coverage until replacement coverage is issued and in force.

If you are considering replacing an existing policy, ask your agent for the replacement disclosures required in your state and compare the costs and benefits carefully before you act.

09Agent opportunities and independent contractor status

Parts of this Site describe the opportunity to build a practice with Eterna as a licensed independent agent. Nothing on this Site is an offer of employment.

Submitting an agent application does not create a contract and does not guarantee a contract, a carrier appointment, a commission level, leads, territory, or support. Eterna may accept or decline any applicant at its sole discretion.

Agents who contract with Eterna do so as independent contractors. Nothing on this Site or in any communication from us creates an employment relationship, partnership, joint venture, or franchise. Agents control their own schedule and methods and are responsible for their own licensing, continuing education, errors and omissions coverage, business expenses, and taxes.

Income disclaimer

Any commission rate, production figure, or earnings example shown on this Site or in our recruiting materials is an illustration only. It is not a promise, projection, or guarantee of income. Agent income is commission based and depends on licensing, effort, skill, activity, market conditions, carrier compensation schedules, chargebacks, and persistency. Results vary widely, and many agents earn little or no income.

10Acceptable use of the site

You agree to use the Site lawfully and respectfully. You agree not to:

  • Submit false, misleading, or stolen information, or impersonate another person
  • Use the Site to solicit our clients or agents, or to promote another agency or product
  • Scrape, crawl, harvest, or copy content, contact data, or agent information by automated means
  • Attempt to gain unauthorized access to the Site, our systems, or any account
  • Upload malware, interfere with the Site's operation, or test its security without written permission
  • Reverse engineer, frame, or resell any part of the Site
  • Use the Site in violation of any law, including insurance, privacy, telemarketing, or export laws

We may investigate suspected misuse, restrict or terminate access at any time, and report unlawful activity to regulators or law enforcement.

11Electronic communications and E-Sign consent

When you use the Site or contact us, you consent to receive communications from us electronically, including by email, text, and notices posted on the Site. You agree that electronic communications, records, and signatures satisfy any legal requirement that a communication be in writing.

You may be asked to sign applications, disclosures, or agreements electronically. By signing electronically, you agree that your electronic signature is legally binding under the federal E-Sign Act and applicable state law.

To receive documents on paper, or to withdraw consent to electronic delivery, email info@goeterna.com or call (949) 787-5212. Withdrawing consent may delay or prevent certain services. To receive and keep electronic records you need a device with internet access, a current browser, a working email address, and the ability to view and save PDF files.

12SMS and text message program

Eterna Insurance Solutions offers an optional SMS program for appointment reminders, application and policy status updates, agent onboarding notices, customer care, and occasional promotional messages. Participation is voluntary.

How you opt in

You may opt in by checking the SMS consent box on a form on this Site, by texting us first, by giving verbal consent to a licensed agent on a recorded call, or by signing a paper or electronic form that includes SMS consent language. We keep a timestamped record of your consent, including the method and the disclosure shown to you.

Consent is optional

Consent to receive text messages from Eterna is not a condition of purchase and is not required to receive a quote, buy a policy, or contract as an agent. Your consent applies only to messages from Eterna Insurance Solutions. We do not transfer, share, or sell your consent to any other brand or company.

Message frequency and cost

  • Message frequency varies and depends on the programs you join and your activity with us. Most subscribers receive fewer than 10 messages per month.
  • Message and data rates may apply for certain programs, announcements, and notifications. These charges come from your mobile carrier, not from Eterna.
  • Messages may not be deliverable in all areas or on all carriers. Wireless carriers are not liable for delayed or undelivered messages.
  • You must be at least 18 years old and the account holder or an authorized user of the mobile number you provide.

How you opt out and get help

  • Reply STOP to any message to opt out. We will send one confirmation and then stop messaging you.
  • Reply HELP for assistance, or email info@goeterna.com, or call (949) 787-5212.
  • You may also revoke consent by any other reasonable method, including telling an agent on a call or writing to us. We honor opt out requests promptly and no later than 10 business days.
  • If you change or give up your mobile number, please tell us so we do not message the new owner.
Mobile opt-in privacy

Mobile opt-in information will never be shared or sold to third parties or affiliates for marketing or promotional purposes.

Our full SMS practices are described in our Privacy Policy.

13Phone calls and do not call requests

When you give us your phone number and ask us to contact you, you agree that Eterna and the licensed agents who work with us may call or text you at that number about your request, including with automated technology and prerecorded or artificial voice messages. Consent is not a condition of purchase.

You may revoke consent at any time by any reasonable method, including replying STOP to a text, telling an agent on a call, or emailing info@goeterna.com. We keep an internal do not call list and honor requests within 10 business days, and sooner where we can. Calls may be monitored or recorded for quality, training, and compliance, and we will tell you when that applies.

14Intellectual property

All content on the Site, including text, graphics, logos, photography, video, audio, layout, and code, is owned by Eterna Insurance Solutions or its licensors and is protected by United States and international intellectual property law.

You may view and print content for your own personal, non commercial use. You may not reproduce, republish, distribute, modify, create derivative works from, publicly display, or commercially exploit any content without our prior written permission.

The Eterna name, logo, wordmark, and related marks are the exclusive property of Eterna Insurance Solutions. Carrier names and logos that appear on the Site belong to those carriers and are used with permission where required. Nothing here grants you a license to use any mark.

If you believe content on the Site infringes your copyright, send a notice under the Digital Millennium Copyright Act to info@goeterna.com with a description of the work, the location of the material, your contact details, and a statement of good faith belief.

15Privacy

Your use of the Site is also governed by our Privacy Policy, which is part of these Terms by reference. It explains what personal information we collect, how we use and share it, how long we keep it, and the rights you have.

By using the Site or submitting a form, you agree to the collection and use of your information as described in the Privacy Policy.

16Third party links and services

The Site may link to carrier websites, quoting engines, scheduling tools, payment processors, and other third party services. Those links are offered for convenience. We do not control and are not responsible for the content, availability, privacy practices, security, or terms of any third party site.

Your use of a third party service is at your own risk and is governed by that provider's terms and privacy policy. Please review them before you share information.

17Disclaimer of warranties

The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Eterna disclaims all warranties, whether express, implied, or statutory, including:

  • Implied warranties of merchantability, fitness for a particular purpose, title, and non infringement
  • Warranties that the Site will be uninterrupted, timely, secure, or free of errors, viruses, or harmful components
  • Warranties about the accuracy, completeness, reliability, or currency of any content, quote, illustration, or calculator result

Some states do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

18Limitation of liability

To the fullest extent permitted by law, Eterna Insurance Solutions and its owners, officers, directors, employees, contracted agents, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to the Site or our services, including:

  • Loss of revenue, profits, business, goodwill, or data
  • Reliance on any content, quote, or illustration on the Site
  • Unauthorized access to or alteration of your transmissions or data
  • Any act, omission, underwriting decision, claim decision, or insolvency of an insurance carrier
  • Any other matter relating to the Site or our services

Our total liability for all claims arising from the Site or our services will not exceed the greater of the amount you paid directly to Eterna in the twelve months before the claim, or one hundred dollars.

These limits apply regardless of the legal theory and even if we were advised of the possibility of damages. Nothing in this section limits liability that cannot be limited by law, including liability for fraud or willful misconduct. Some states do not allow certain limits, so parts of this section may not apply to you.

19Indemnification

You agree to indemnify, defend, and hold harmless Eterna Insurance Solutions and its owners, officers, directors, employees, contracted agents, and affiliates from any claim, liability, damage, loss, or expense, including reasonable attorney fees, arising out of or related to your use of the Site, your breach of these Terms, information you submitted, or your violation of any law or of the rights of a third party.

20Complaints, cancellations, and claim disputes

Filing a complaint with Eterna

If you have a concern about the service you received from Eterna or one of our licensed agents, contact us directly. We take every complaint seriously and work to resolve it promptly.

We will acknowledge your complaint within 2 business days and work toward a resolution as quickly as we can.

Escalating to your state regulator

If we do not resolve your complaint to your satisfaction, you have the right to file it with your state Department of Insurance. State insurance regulators oversee agents, agencies, and carriers, and can investigate on your behalf. Find your state's department through the National Association of Insurance Commissioners at naic.org. Nothing in these Terms limits your right to contact a regulator.

Policy cancellations

Eterna is an independent agency. We help place coverage on your behalf, but we do not underwrite, issue, or hold your policy. For that reason, cancellations must be requested directly with your insurance carrier, not with Eterna.

To cancel, contact your carrier's service department using the information on your policy documents. Your Eterna agent can help you find the right contact and walk you through the process.

We encourage you to speak with your agent first. There may be other options, such as reducing the face amount, adjusting the premium mode, using a policy loan, or applying a nonforfeiture option, that fit your situation better than losing coverage.

Free look period

Most states require carriers to provide a free look period, often 10 to 30 days from the day you receive the policy, during which you may cancel for any reason and receive a refund of premiums paid. The length varies by state, product, and carrier. Check your policy documents for the free look period that applies to you.

Claim disputes

If a claim is denied and you believe the decision is wrong, you have the right to appeal directly with the carrier. If the appeal does not resolve it, you may escalate to your state Department of Insurance. Your Eterna agent can help you understand the process, though the claim decision rests with the carrier.

21Dispute resolution, arbitration, and class action waiver

Please read carefully

This section affects your legal rights. It requires most disputes to be resolved by binding individual arbitration instead of in court, waives your right to a jury trial, and prevents you from bringing or joining a class action. You may opt out within 30 days, as described below.

Talk to us first

Before starting arbitration, you agree to send written notice of the dispute to info@goeterna.com or to our Irvine address, describing the issue and the relief you want. We will do the same. Both sides agree to try in good faith to resolve the dispute informally for 60 days after that notice.

Binding arbitration

If we cannot resolve the dispute informally, any claim arising out of or relating to these Terms, the Site, or our services will be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator. The arbitration will take place in Orange County, California, or by video or telephone at your election. The Federal Arbitration Act governs this section. The arbitrator's award may be entered in any court with jurisdiction.

Class action and jury trial waiver

All claims must be brought in an individual capacity. Neither you nor Eterna may bring a claim as a plaintiff or class member in a class, consolidated, or representative action, and the arbitrator may not consolidate claims or preside over any form of class proceeding. You and Eterna waive the right to a trial by jury.

Exceptions

Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property or address unauthorized access to the Site. Nothing here prevents you from filing a complaint with a state Department of Insurance or another government agency.

How to opt out

You may opt out of this arbitration agreement within 30 days after you first accept these Terms by emailing info@goeterna.com with the subject line "Arbitration Opt Out" and including your full name, address, and the email or phone number you used with us. Opting out will not affect any other part of these Terms.

Severability of this section

If the class action waiver is found unenforceable as to a particular claim, that claim will be severed and heard in court, and the rest of this section will remain in force.

22Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law rules. For any dispute not subject to arbitration, you and Eterna agree to the exclusive jurisdiction and venue of the state and federal courts located in Orange County, California. Nothing in this section limits any right you have under the insurance laws of your home state.

23Changes to these terms

We may update these Terms at any time. When we do, we will change the "Last updated" date at the top of this page. If a change is material, we will provide additional notice where required by law, such as a banner on the Site or an email.

Continuing to use the Site after we post revised Terms means you accept the changes. Please review this page from time to time.

24General provisions

  • Entire agreement. These Terms and the Privacy Policy are the full agreement between you and Eterna about the Site and replace any earlier understanding on that subject. They do not replace any separate signed agreement, such as an agent contract or a carrier policy contract.
  • Severability. If any provision is found unenforceable, it will be limited or removed to the minimum extent needed and the rest will stay in effect.
  • No waiver. If we do not enforce a right, that is not a waiver of it.
  • Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Force majeure. Neither party is liable for delays caused by events beyond reasonable control, including natural disasters, outages, and government action.
  • Survival. Sections on intellectual property, disclaimers, limitation of liability, indemnification, arbitration, and governing law survive any termination.
  • Notices. Legal notices to Eterna must be sent to 43 Discovery, Suite 260, Irvine, CA 92618, or to info@goeterna.com. We may give you notice by email, by text, or by posting on the Site.
  • Headings. Section headings are for reference only and do not affect interpretation.
  • Accessibility. We are working to keep goeterna.com usable for everyone. If you have trouble accessing any part of the Site, contact us and we will help you get the information you need.
